The government decree of July 29, 1939 concerns the ‘protection of the family and natality’. In a section entitled ‘Protection of the race’ pornographic publications are condemned as ‘constituting an offence to the dignity of the family’. According to barrister Daniel Bécourt, this government decree dating from 1939, in the section which treats offence to public decency ‘marks an important new stage, by definitively placing all modes of expression, including the book, under common law.’ It extends the area of application of the administrative banning of foreign books already provided in the law of 1881. The government decree of 1939 is included in the Penal Code of 1957.
